OnDemand Program:
New Capital Gain Strategies: Section 1031 and Structured Sale Options
Description:Are you or your clients experiencing a huge capital gain tax consequence? Are you looking for tax deferral solutions on a failed 1031 Exchange, significant equity boot situation, or non-exchangeable item such as primary residence, business good will, busted installment sale, etc.?

The solution is a structured sale tax deferral strategy, under Section 453, for sellers of real estate and businesses. This is an improved version of traditional "installment sales." It allows the seller to take advantage of tax benefits and income security that were not previously available.

This seminar will discuss tax savings options for the following:
  • Failed Exchange - The exchange fails because client does not identify or close on a replacement property in the allotted time frame.

  • Equity Boot - Client falls short on exchanging into property that is at least as valuable as the relinquished property (Napkin Rule).

  • Personal Residences - Homeowner sells their residence for a large gain--this amount can be structured. Perfect for supplementing retirement.

  • Sale of Business/Good Will Tax Consequence - A structured sale can provide tax deferral relief on the good will.

  • Busted Installment Sale - Original buyer sells property which triggers taxable event for original seller. This strategy satisfies both parties.

  • Investor Leaving the Real Estate Market - A structured sale provides tax-deferred income stream to those who no longer want to own real estate.
