Real Estate Fundamentals: Basic Commercial Underwriting (Illinois) (an ATG Legal Ed Connect program)
PROGRAM SUMMARY:
There are scores of underwriting issues unique to commercial transactions including surveys, endorsements, and title clearance of special exceptions. The speaker will focus on the commercial commitment, why we raise certain exceptions and what is needed to waive them, surveys and survey issues, and the most common endorsements requested by both lenders and buyers in commercial transactions. Topics include the following:
- Definitions of what constitutes commercial property;
- Special endorsement issues peculiar to commercial transactions;
- Types of closings to expect in a commercial transaction, such as New York Style or Deed and Money Escrow;
- Common entities in corporate transactions, including corporations, partnerships, and LLCs; and
- Typical exceptions raised on commercial commitment.
