PROGRAM SUMMARY:
Asset protection planning has become a well-recognized area of practice that is now viewed by a significant number of estate planning attorneys and other wealth planners as a necessary component of planning. In fact, many planners believe that the failure to advise a client about asset protection planning options may be grounds for a claim of malpractice. This program discusses common situations that pose ethical dilemmas for estate planning practitioner and the relevant Illinois Rules of Professional Conduct. Examples include the following:
- Ethics of asset protection;
- Fraudulent transfers;
- Life Insurance with elderly clients; and
- Responsibility regarding competency with elderly clients.
The program will also review the following ethics references:
- Illinois Rules of Professional Conduct;
- Illinois State Bar Association Ethics Opinions;
- Attorney Registration and Disciplinary Commission Opinions; and
- Appellate Court Decisions.
