Against the backdrop of landmark changes to our industry (see "A Year-End Review of 2013," December 2013 ATG Trusted Adviser) ATG is poised to begin 2014 in a position of financial strength, our eye on the community, and a mood of celebration. I assure you that these issues will remain in the forefront as we begin 2014 — but I also assure you that there are exciting, more lighthearted things on the horizon, too.

Construction; Mechanic's Liens: Von Tobel Corp. v Chi-Tec Constr. & Remodeling — Claimant’s name on mechanic’s pre-lien notice and the lien notice need not match identically; idem sonans is permitted. Notice will be sufficient if it substantially complies with the statute while considering three factors: (1) degree of non-compliance; (2) satisfaction of the underlying policy of the statutory provision; and (3) prejudice that may have resulted from non-compliance.

Adverse Possession: Allen v Woelfel Family Revocable Trust — Homeowner did not have a prescriptive easement on neighbor’s driveway because the neighbor had given the previous owner permission to use the driveway, so the use was not adverse.
