FinCEN Residential Real Estate Rule

Effective Date: March 1, 2026

New Schedule B Language: January 1, 2026

Our most recent FinCEN notice (September 30, 2025) explained the U.S. Department of the Treasury’s Financial Crimes Enforcement Network (FinCEN) postponement of reporting requirements of the Anti-Money Laundering Regulations for Residential Real Estate Transfers Rule (RRE Rule) until March 1, 2026.

 

FinCEN took this step to provide the industry with more time to comply—consistent with the Administration’s agenda to reduce compliance burden—while still adequately protecting the U.S. financial system from money laundering, terrorist financing, and other serious illicit finance threats.

New Schedule B Exception Language for Commitments Issued after January 1, 2026


In preparation for the March deadline, Advocus will require the addition of specific Schedule B Exceptions to all Commitments starting January 1, 2026. Find the new Exception language on page 5 of our Overview: FinCEN Final Residential Real Estate Rule.
