Comprehensive Endorsement 1 Retired in Favor of ALTA 9.3 Endorsement

ATG has retired the Comprehensive Endorsement 1, ATG Form 2008. Instead, you are advised to issue the ALTA 9.3 Endorsement, Covenants, Conditions, and Restrictions – Loan Endorsement (ALTA 9.3-06). This endorsement is an American Land Title Association (ALTA) form, so it is better known to lenders and provides similar coverage to the Comprehensive Endorsement 1. Therefore, when requested to issue a Comprehensive Endorsement, please issue the ALTA 9.3.

The ALTA 9.3 Endorsement is for use on loan policies insuring title to non-residential land where there is a concern about the minerals title. This endorsement does not provide any minerals coverage, so can be used any time the minerals are severed, leased, or the property is in an area with substantial mining activity.

For REsource® users, you can find the ALTA 9.3 endorsement in the “Print / Create Documents” list on the Utilities menu. This endorsement is labeled as “END06 CCR–Loan/ALTA 9.3.” Further, if you choose to print the Comprehensive Endorsement 1, now the ALTA 9.3 will print instead. Because the ALTA 9.3 endorsement is an ALTA form, it will appear as a checked box on Schedule A of the Loan Policy, and there is no need to print the endorsement form and attach it to the Loan Policy.

In a related change, ATG is also retiring the Owner's Comprehensive Endorsement and the Owner's Comprehensive Endorsement 1B. Instead, you are advised to use the Covenants, Conditions and Restrictions - Unimproved Land - Owner's Endorsement (ALTA 9.1-06), and the Covenants, Conditions and Restrictions - Improved Land - Owner's Endorsement (ALTA 9.2-06), choosing the appropriate endorsement based on whether improvements are located on the land to be insured.

In general, when requested to issue a Comprehensive Endorsement, please choose one of the Covenants, Conditions and Restrictions endorsements in the ALTA 9 series.
