Sunset of the Notarial Record
The Notarial Record requirement contained in 5 ILCS 312/3-102 subsections (a) through (i) are no longer in effect as of July 1, 2018.
Pursuant to 5 ILCS 312/3-102(k), the requirement for a Notarial Record Form and sellers’ thumbprint for all Cook County transactions "shall not apply after July 1, 2018."
The Notarial Record Statute, (5 ILCS 312/3-102), effective July 1, 2009, and extended on June 21, 2013, applied to every notarial act in Illinois involving a document of conveyance that transferred or purported to transfer title to residential real property located in Cook County, Illinois. The Act required that a Notarial Record of each notarial act performed in connection with a Document of Conveyance be created.
