NOTES:
Coverage: This endorsements insures the insured against loss or damage by reason of the failure of an identified type of improvement to be located on the land at the street address given in the endorsement. Further, the endorsement insures that if a survey is attached to the policy then it shows the correct location and dimensions of the land identified on Schedule A of the policy according to the public records.
Procedure: This endorsement may be issued on Owner's and Loan Policies. To issue this endorsement, you must have information for your title file about the type of improvement located on the land and the street address of the property. In locations where a boundary survey is not standard procedure (outside Chicago and the collar counties, for residential property), you may rely on the listing agreement, appraisal, real estate tax bill or tax maps to verify this information. Use care in reviewing this information and reconciling conflicting information, as mistakes in the street address are a source of claims. Always confirm with the seller or owner, where possible, that the information you have collected is correct.
If there is a new survey prepared for this transaction and the survey depicts all of the land on Schedule A, then the survey may be attached to the final policy to provide the map coverage in this endorsement. Be sure that the surveyor was supplied with the legal description from Schedule A of the commitment in preparing the survey. If the survey to be used for this coverage is an ALTA Survey, then the survey must be certified to Attorneys’ Title Guaranty Fund, Inc. before it may be attached to the policy for this coverage.
