NOTES:

Coverage: This endorsement insures against loss or damage if there is no water, gas, electric, telephone, storm sewer and sanitary sewer services available to the land, as indicated on the endorsement. The utilities must be either located in an adjacent public right of way or on a permanent easement. Further the utilities must actually serve the improvements on the property.

Procedure: This endorsement may be issued on Owner's or Loan Policies for improved property only. To issue this endorsement, take the following steps for each type of named utility service in the endorsement, and then check the boxes for the utilities that meet the criteria below.

1. Obtain a survey.

2. Review the survey to determine whether the property is adjacent to a public right of way, or whether a public utility easement crosses the land, to give a legal right to public utilities to locate equipment.

3. If by easement, obtain a copy of the easement instrument and review to be sure that there is no right in the grantor or the grantors heirs or assigns to terminate the easement, and that the easement benefits public utility companies.

4. If the survey for the transaction is an ALTA survey, then review it for evidence that public utility equipment has actually been installed on the land, and connects to the improvements on the land.

5. If the survey for the transaction is not an ALTA survey, the contact the utility companies and/or municipality in question to obtain letters confirming that utility equipment is installed and connected to the improvements on the property.
