Probate Act: Place and Terms of Sale (P.A. 92-0097)

Effective July 18, 2001, P.A. 92-0097, formerly Senate Bill 1048, amends §20-7 of the Probate Act of 1975, regarding the place and terms of sale. 755 ILCS 5/20-7 (2001). The Act provides that the sale of a decedent's real property may be conducted by means of the Internet or any other electronic means if approved by the court. Section 20-7(a). The Act also states that the usual time restriction that requires the public sale of the property to occur between 10:00 a.m. and 5:00 p.m. does not apply to sales that are conducted by means of the Internet or other electronic means. Section 20-7(b). In addition to the traditional notice of sale that must be given, notice for Internet or electronic sales must be provided by means of the Internet or the other electronic medium. This electronic notice must include a statement that public Internet access is available at public libraries.
