
Tenancy by the Entirety (P.A. 92-0136)
Effective January 1, 2002, P.A. 92-0136, formerly House Bill 1060, amends the Joint Tenancy Act. The act changes the requirements for a conveyance by tenancy by the entirety. The amendment removes the portion of the statute that requires the instrument of devise or conveyance to have language naming and expressly identifying the persons "as husband and wife, not as joint tenants or tenants in common but as tenants by the entirety." 765 ILCS 1005/1c (2001). Also removed is the phrase that requires a land trust interest to expressly state that it is held "by both husband and wife as tenants by the entirety." The provision now reads that a transfer that "expressly declares that the devise or conveyance is made to tenants by the entirety, or if the beneficial interest in a land trust is to be held as tenants by the entirety, the estate created shall be deemed to be in tenancy by the entirety." 765 ILCS 1005/1c (2001).
