Title Insurance Agents Must Maintain Current Address Information with Underwriters

The title insurance section of the Illinois Department of Financial and Professional Regulation (IDFPR) has notified ATG that all title insurance agents should be made aware of the state's requirements for title agents to provide current address information to the state through their underwriter. It is required that all title insurance agents provide current address information to the State of Illinois to maintain their title insurance registrations (clickhereto see what the IDFPR has on file for you).

The State of Illinois registers each title insurance agent to operate at a specific address. The address is printed on the Certificate of Registration. The Certificate of Registration must be conspicuously displayed for the public or maintained at the registered agent&€™s principal place of business for inspection upon request. 50 Illinois Administrative Code Section 8100.110. The registration and the Certificate are both address-specific. If a registered title insurance agent moves and changes addresses, the underwriter (ATG) must report this change within a maximum of ten business days. 50 Illinois Administrative Code Section 8100.105.

Operating at an address other than the address noted on the Certificate is an act of noncompliance that must be reported and may also be a violation of 215 ILCS 155/21(a)(1). In the event the state revokes a registration under Section 21 of the Act due to a material misstatement concerning the agent&€™s location, the agent is not eligible to apply for registration again for a period of one year. 50 Illinois Administrative Code Section 8100.115.
