The Illinois Responsible Property Transfer Act (P.A. 92-0299)

Effective August 9, 2001, P.A. 92-0299 repeals The Illinois Responsible Property Transfer Act of 1988 (IRPTA), 765 ILCS 90/1-7. Any actions under the Act that accrued prior to August 9, 2001, may still be maintained in accordance with IRPTA. The repealed act was effective November 1, 1989, and its purpose was to create a system to ensure that parties to a real estate transaction were aware of the environmental condition of property, including past use and any environmental liabilities. 765 ILCS 90/2. IRPTA required that a disclosure document be delivered to the transferee and the lender in a real estate transaction, filed with the Environmental Protection Agency, and recorded in the office of the recorder in the county in which the property is located. 765 ILCS 90/4, 90/6.
