
Home Repair and Remodeling Act
P.A. 94-0490 (H.B. 2594): Act added section 815 ILCS 513/15.1 and amended sections 815 ILCS 513/15, 513/30. Effective January 1, 2006.
Public Act 94-0490 (the Act) amended the Home Repair and Remodeling Act. First, the Act added a new section that requires home repair and remodeling businesspeople to notify consumers of certain contractual provisions. When a businessperson presents or prepares a written offer for a consumer, the businessperson must notify the consumer of contractual provisions on binding arbitration and waiver of jury trial. 815 ILCS 513/15.1(a). If the businessperson fails to notify the consumer of the arbitration or jury trial waiver clauses, the clauses are void. 815 ILCS 513/15.1(c).
The consumer must accept or reject the clauses by writing his or her name and the words "accept" or "reject" next to the clauses. 815 ILCS 513/15.1(b). The consumer must agree to both clauses before the contract is valid. Rejection of one or both of the clauses is a counteroffer, which the businessperson may accept or reject. If the businessperson fails to get acceptance or rejection of the clauses and the consumer's signature, the clauses are void. 815 ILCS 513/15.1(c).
Finally, the Act makes it unlawful for home repair and remodeling businesspeople to repair or remodel on contracts or work orders for over $1,000 without the consumer's signature on the contract or order, and without notification and acceptance or rejection of the binding arbitration and waiver of jury trial clauses. 815 ILCS 513/30.
