PRICING FEES AND PREMIUMS

Remember that you should be charging clients what is reasonable and customary in your area for the types of title products and services you provide. While ATG does not specifically instruct you what to charge for your title work, Regulation 4(I) does provide a guideline:

An ATG member shall charge and collect fees for providing services or products as a title insurance agent of ATG that do not exceed fees customarily charged in the locality for those services or products.

In addition, Rule 1.5 of the Rules of Professional Conduct requires that a lawyer's fees be reasonable. This rule renders excessive fees for legal work in a real estate transaction in violation of the Rules of Professional Conduct, which could require a sanction.

ATG is aware that you may encounter difficulty in pricing your title work competitively in your area. Please call a staff attorney or senior executive staff, 800.252.0402, to discuss any marketing and/or financial problems that may develop with your title work.
