
WHAT IS PRIOR TITLE EVIDENCE?
Prior title evidence includes any of the following:
- An owner or mortgagee title insurance policy from any title insurance company (exception: Mid America Title Insurance Company policies may not be relied upon as prior title evidence);
- A commitment for a title policy from which a title insurance policy was issued; and
- An abstract with an attorney opinion letter if the attorney opinion letter was prepared by the ATG member attorney.
Examples:
- The ATG member prepares or has in the past prepared an attorney opinion letter for a previously updated abstract and then obtains a title search from the date of the abstract through the present time. The commitment is prepared based upon our member attorney's opinion letter and the current title search.
- The ATG member obtains a new update of an abstract and then prepares an attorney opinion letter from which the commitment is prepared.
