PROGRAM SUMMARY:
This program will analyze America's mortgage crisis from the perspectives of a U.S. bankruptcy judge, a U of I College of Law business law professor, and a practicing real estate lawyer. The speakers will open with a look at the origins of the sub-prime mortgage crisis and how sub-prime lending expansion and over-selling the American Dream pushed the real estate market over the limit. They will analyze the secondary mortgage market, the critical role of investment banks and credit rating agencies, and the role of the mortgage servicer. The program will then probe the response of the government and real estate industry, the role of Fannie Mae and Freddie Mac, and take a look at H.R. 3221 and industry changes.
The program will look at current strategies you can use to assist clients facing foreclosure. Topics include the following:
- How the U.S. secondary mortgage market functions
- Why sub-prime lending went so wrong
- The role played by lenders and mortgage brokers
- Personal responsibility
- How the government and industry responded
- Proposed HUD rules
- Illinois Anti-Predatory Lending Database Program
- Other action that could/should be taken
- What attorneys can do to help clients facing foreclosure
- Defenses to foreclosure
- Short sale strategies
- How to expand the role of attorneys in residential real estate to reduce the risks inherent in today's market
The program will conclude with a look at current strategies you can use to assist clients facing foreclosure. The program is followed by a reception in the Pedersen Pavilion hosted by ATG.
