I am writing to request that you support Senate Bill 2262. The legislation addresses a specific business practice in the title and settlement services industry that negatively impacts consumers, stifles competition, and impairs lawyers' ability to exercise independence when they represent a consumer who is buying or selling a home. 

This legislation is designed to clarify that it is a violation of the Illinois Title Insurance Act for a party to refer of a consumer based on a stated or implied agreement that the consumer will purchase title and settlement services from a specific captive title insurance agency.

I believe in fair competition, however, some broker-owned captive companies engage in coercion by requiring lawyers to select the broker-owned captive title agency in exchange for the referral of a legal client. With the explosive growth in broker-owned captive title agencies in recent years, this practice increasingly impedes my ability as a lawyer and a title agent to exercise independence in the representation of my client.

Competition is good for the title and settlement business; selecting a provider should be made not on the basis of a forced quid pro quo, but rather on the basis of what is best for the consumer.
