New Disclosure Form Implementation Delayed until June 1, 2018
IDFPR Sets New Effective Date in Response to Industry Input
As previously reported, the Title Insurance Division of the Illinois Department of Financial and Professional Regulation (IDFPR or the department) proposed a new disclosure form to be executed by title insurance agents and underwriters when title insurance is referred by a "producer" as defined under the Title Insurance Act. The form had an effective date of April 4, 2018.
ATG has a number of serious concerns about the content of the disclosure, whether the IDFPR has the authority to implement it, and perhaps most importantly, the bias against lawyer agents contained in both the disclosure form itself and in the Instructions for completing it.
ATG took action in voicing its concerns to advocate on behalf of lawyer agents and the clients they serve (see our May 4 letter). The result — the IDFPR will delay its implementation until June 1, 2018. Read more...
