Changes to Probate Act Regarding Adult Dependent Children

Public Act 100-0478 amends section 15-1 and 15-2 of the Probate Act regarding awards for adult dependent children. The amendment removes the term "adult dependent children" from section 15-1(a) and 15-2(a) and extends the statute by incorporating sections 15-1(a-5) and 15-1(b-5). The incorporated sections provide awards for "each adult child of the decedent who is likely to become a public charge and was financially dependent on the decedent and resided with the surviving spouse at the time of the decedent's death.

The Amendment decreased the award from $10,000 to $5,000 to each adult dependent child "and shall otherwise be consistent with the financial support that the decedent was providing the adult child immediately prior to the decedent's death." To receive the award, within 30 days of receiving written notice of the potential award from the representative or affiant of the decedent, the adult child, or her agent, "shall provide written notice to the representative or affiant asserting that the adult child was financially dependent on the decedent at the time of the decedent's death. Failure to provide written notice to the shall be a bar to the right to receive the award.
