This bill amends the Mechanics Lien Act concerning the time for completing a contract for work or for materials in order to obtain a lien. The act previously allowed mechanics liens regardless of whether there was a stipulated time of completion or time of payment in the contract so long as work was done or material was furnished within three years.

The amended version of the act still does not require a stipulated time of completion or time of payment but adds language which specifies different time requirements for residential and non-residential property. The Act maintains the three-year time requirement pertaining to the commencement of a contract for work or materials furnished, but only to a residential property. The act includes additional language extending the time requirement to five years from commencement of contracts for work or materials for non-residential property.  The Act further states that the changes made become inoperative three years after the effective date (January 1, 2013) of this amendatory Act.
